
Dinglis Management Ltd & Anor v Dinglis Properties Ltd[2019] EWCA Civ 127
The Court of Appeal has handed down its decision in the case of Dinglis Management Ltd (“DML“) & Anor v Dinglis Properties Ltd (“DPL“) [2019] EWCA Civ 127, in which Ingram Winter Green acted for the successful appellants, DML and Paul Dinglis.
Overturning the finding made by the judge at first instance in the High Court, the Court of Appeal concluded that DML had not acted as the agent of DPL in relation to the management of properties owned by DPL. As a result of that conclusion, the findings of personal liability made at first instance against Paul Dinglis fell away.
The Respondent, DPL, brought several cross-appeals against DML and Paul Dinglis, all of which were dismissed.
